Privacy Policy

This Privacy Policy ("Policy") applies to https://poolpartypickem.com and Pool Party Pick Em LLC ("Company") and governs data collection and usage. For the purposes of this Policy, unless otherwise noted, all references to the Company include https://poolpartypickem.com (the "Service"). By using the Company website, you consent to the data practices described in this statement.

I. Collection of Your Personal Information

In order to provide you with the Service, the Company collects the following information directly from you:

Please keep in mind that if you directly disclose personal information through the Company's Group chat feature, that information may be seen by other members of that Group.

We do not collect personal information about you unless you voluntarily provide it to us, such as when you: (a) register for an account; (b) send us an email message; or (c) subscribe to a paid Group, in which case your payment information is submitted directly to Stripe. We will use your information to operate and provide the Service you have requested. We may also gather additional personal or non-personal information in the future as the Service evolves, and we will update this Policy accordingly.

II. Use of Your Personal Information

The Company collects and uses your personal information in the following ways:

  • to operate and deliver the Service you have requested, including picks, scoring, leaderboards, Groups, and Group chat;
  • to provide you with information about the Service that you request from us;
  • to provide you with notices about your account;
  • to carry out the Company's obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • to notify you about changes to the Service;
  • to maintain the security of the Company's services and prevent fraud or misuse, including screening Group chat messages for slurs and hateful or harassing language before they're posted;
  • to comply with applicable laws, regulations, legal processes, or governmental requests;
  • to maintain the Company's internal records and administrative functions; and
  • for any other purpose with your consent.

The Company does not sell your personal information, and does not share it with advertisers.

III. Sharing Information with Third Parties

The Company does not sell, rent, or lease your personal information to third parties. We share limited information only as needed to run the Service:

  • Stripe (our payment processor) receives the billing information needed to process your subscription payment. Stripe's own privacy policy governs its handling of that data.
  • Other members can see your display name, picks, points, and leaderboard position; members of a Group you join can additionally see your activity and chat messages within that Group.

The Company may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Company or the site; (b) protect and defend the rights or property of the Company; and/or (c) act under exigent circumstances to protect the personal safety of users of the Company, or the public.

IV. Opt-Out of Sale or Sharing of Personal Information

The Company does not sell your personal information for monetary or other valuable consideration, and does not share it for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act of 2018 (CCPA) and similar state privacy laws. Because we do not sell or share personal information in this way, there is currently no sale or sharing to opt out of. If you have questions about how we handle your data, or wish to exercise other rights available to you under applicable privacy law (such as the right to know, delete, or correct your information), please contact us using the information in Section XIII.

V. Tracking, Cookies, and Advertising

The Company does not track your behavior across the Service to build a profile of your interests or to deliver customized advertising, and we do not run any third-party analytics, advertising, or ad-tracking scripts on the site. The Service uses a single, strictly necessary cookie — a secure, HTTP-only session cookie — solely to keep you signed in between visits.

VI. Automatically Collected Information

The Company may automatically collect standard technical information when you access the Service, such as your IP address, browser type, device information, access times, and referring website addresses. This information is used to operate the Service, maintain its security and quality, and troubleshoot issues — it is not used to personalize content or advertising.

VII. Links

This website may contain links to other sites, such as Stripe's checkout pages. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage you to read the privacy statements of any other site that collects personal information.

VIII. Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and
  • Direct any service providers to delete your personal information from their records.

We may not be able to comply with requests to delete your personal information if it is necessary to:

  • Complete a transaction for which the information was collected, or otherwise perform a contract between you and us;
  • Detect security incidents, or protect against malicious, deceptive, fraudulent, or illegal activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, or ensure another user's right to exercise free speech or another right provided by law;
  • Comply with an existing legal obligation; or
  • Otherwise use your personal information internally in a lawful manner compatible with the context in which you provided it.

You can also review and update most of your account information directly from your dashboard at any time. Depending on where you live, you may have additional rights under laws such as the GDPR or CCPA/CPRA. Contact us and we'll do our best to honor applicable requests.

IX. Data Security and Breach Notification

The Company maintains reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, acquisition, disclosure, or use, including hashing passwords with bcrypt and using secure, HTTP-only session cookies. No method of storage or transmission is completely secure, and we can't guarantee absolute security.

In the event of a security incident involving personal information, the Company will promptly investigate the incident and provide notice to affected individuals and, where required, to applicable regulatory authorities, in the manner and within the timeframes prescribed by applicable law. Our internal process for investigating and responding to security incidents is described in our Data Breach & Security Incident Response Policy.

X. Children Under 13

The Company does not knowingly collect personal information from children under the age of thirteen. If you are under the age of 13, you must ask your parent or guardian for permission to use this platform. If you believe a child has provided us with personal information, please contact us so we can delete it.

XI. Email Communications

From time to time, the Company may contact you via email regarding your account, security or billing notices, and updates related to the Service, such as new pools, events, or features.

XII. Changes to This Statement

The Company reserves the right to change this Policy from time to time — for example, when there are changes in our services, our data protection practices, or the law. When changes are significant, we will inform you by placing a prominent notice on our website and/or emailing the primary address on your account. Your continued use of the Service after such modifications constitutes your acknowledgment of, and agreement to be bound by, the modified Policy.
